Is there a state law that regulates mobilehome parks?

There are several state laws that apply. One of these is the Mobilehome Residency Law which governs many landlord-tenant matters in mobilehome parks. The park owner is supposed to provide mobilehome residents with a copy of this document by February 1 of each year. If you do not have a copy of this document, you may ask your park manager if they have extra copies available. The Mobilehome Residency Law begins with Section 798 of the Civil Code and can be reviewed at the State legislature's website.

What about the charges for electricity, gas and water?

The Mobilehome Residency Law allows park owners to bill residents separately for these utilities. The park owner buys these from a utility company and resells them to residents. How they do this is regulated by state and/or local laws.

The park is also charging me a sewer fee. Can they do this?

The Mobilehome Residency Law considers these to be a type of utility charge. The amounts are set by the City of San José. You can check to see if the right amount is being charged by calling the Finance Department at (408) 277-5195.

Can the park charge a $2.00 HCD inspection fee?

Someone inspected the park and the park owner is requiring me to make repairs on my mobilehome. Who is doing this?

The California Department of Housing and Community Development conducts routine inspections of all mobilehomes and parks. If they find a violation of the State's laws or regulations they may require the mobilehome owner or park owner to correct the violation. I can't afford to make repairs to my mobilehome. Can someone help me?
