The Maximum Annual Percentage Increase for October 1, 2006, through September 30, 2007 is limited to 3%. Rent increases for
later periods are set by the City of San José at 75% of the San
Francisco-Oakland All Urban Consumers CPI, with a minimum of 3% and a
maximum of 7%. Park owners must request a formal administrative hearing
before going over this amount.
If rent was not increased in the prior year the park may combine the
percentages for the two years.
There must be at least 12 months between any two
rent increases. All owner occupied mobilehomes have their rent
increases at the same time.
Rent may not, with few exceptions, be increased
when the mobilehome is sold or transferred. The exceptions are
abandonments, an eviction by a court or a dealer pull-out.
Exceptions to the Ordinance include government subsidized rents and
certain long term (over 12 month) leases.
The implementation of the Ordinance is overseen by the Mobilehome
Advisory Commission, which meets at 5:00 P.M..on the 3rd Thursday of
even numbered months at City Hall. The Commission advises the City
Council on changes in the Ordinance and regulations.
The administration of the Ordinance is funded by an annual Mediation
Fee. The fee for July 2006 through June 2007 is
$6.26 per mobilehome space. One half of the fee is paid by
mobilehome residents and one half by the park owner.
