Inclusionary Housing Policy (RDA Areas)
San José’s Inclusionary Policy, implementing Health and Safety Code Section 33413, applies to all new housing projects with 11 or more units built within a Redevelopment Project Area in the City of San José.

Inclusionary Housing Ordinance (Citywide)
San José’s Citywide Inclusionary Housing Ordinance was approved in January 2010 and requires developers to include a proportion of affordable units in their properties. Once it takes effect (see Operative Date below), the Ordinance will apply to all new and substantially-rehabilitated housing projects with 20 or more units built within the City of San José’s municipal boundaries, including redevelopment project areas.
Operative Date: The Citywide Inclusionary Housing Ordinance will become operative at the earlier of: 1) six months after the City issues 2,500 residential building permits, of which half must be issued for units located outside of the North San José Development Policy Area, within a twelve month consecutive period, or 2) January 1, 2013.
